RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
EVENT: Candlelight Snowshoe, organized by the Iron County Trail Club
In consideration of being permitted to participate in the Candlelight Snowshoe event and any related activities (hereinafter referred to as "the Activity") organized by the Iron County Trail Club, its officers, directors, volunteers, agents, representatives, sponsors, property owners, and property managers (hereinafter collectively referred to as "the Organization"), I hereby freely and voluntarily, without duress, execute this Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement (hereinafter referred to as "the Agreement").
1. ASSUMPTION OF RISK
I acknowledge that participation in the Activity involves inherent risks, dangers, and hazards, including but not limited to: uneven and unpredictable terrain; snow and ice conditions; cold weather exposure including hypothermia and frostbite; open flames and candles along the trail; limited visibility in nighttime conditions; encounters with wildlife; falling branches or trees; physical exertion beyond my fitness level; injury from snowshoe equipment; and other risks inherent to outdoor winter recreational activities. I understand that these risks may result in personal injury, illness, death, or property damage, and I voluntarily assume all such risks.
2. RELEASE OF LIABILITY
I, on behalf of myself, my heirs, personal representatives, and assigns, hereby release, discharge, and hold harmless the Organization, the Iron County Trail Club, its members, officers, directors, volunteers, agents, sponsors, and any landowners or property managers associated with the Activity, from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind arising out of or related to my participation in the Activity, including but not limited to personal injury, death, or property damage, whether caused by negligence or otherwise.
3. INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Organization from and against any and all claims, damages, losses, and expenses, including attorney's fees, arising out of or resulting from my participation in the Activity or any breach of this Agreement.
4. MEDICAL ACKNOWLEDGMENT
I certify that I am physically fit, have sufficiently prepared for participation in the Activity, and have not been advised against participation by a qualified medical professional. I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during the Activity. I understand that the Organization does not provide medical insurance for participants.
5. MINORS
If signing on behalf of a minor (person under 18 years of age), I certify that I am the parent or legal guardian of the minor(s) listed on this waiver. I hereby grant permission for the minor(s) to participate in the Activity and accept full responsibility for any and all risks associated with their participation. This Agreement shall be binding upon the minor(s) and their heirs, personal representatives, and assigns.
6. PHOTO AND MEDIA RELEASE
I grant the Organization permission to use photographs, video recordings, and other media taken during the Activity for promotional, educational, and organizational purposes, including but not limited to social media, websites, and print materials, without compensation or further notice.
7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan. I agree that any legal action arising from this Agreement shall be brought in the appropriate court in Iron County, Michigan.
8. ACKNOWLEDGMENT
I have read this Agreement in its entirety, fully understand its terms, and agree to be bound by them. I understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing this Agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
